General Terms and Conditions of Culm Handels AG (Culm).

Customer satisfaction is our top priority. We undertake to supply the best possible products and services to our valued customers within a reasonable period of time.

In order to ensure the smooth running of the transactions, we ask you to take note of the following terms and conditions.

1. Scope
   The following terms and conditions shall apply to all products and services to be supplied to Culm Handels AG, hereinafter referred to as Culm. Anything else must be recorded in writing.
2. Prices
   All prices are daily rates, which are constantly adjusted and are including MwsT.Unless otherwise stated, offers are valid for four weeks.
3. conditions of payment
   Deliveries to companies shall be invoiced and shall be settled net within 30 days after dispatch. Deliveries to private are made against prepayment or cash on delivery. If no payment is made after the 1st reminder, Culm reserves the right to charge a default of max. 10% per year. In addition, Culm reserves the right to deliver in cash or prepayment in special cases.
4. transport costs
   The transport costs are indicated in the order form and result from a shipping package for the packaging and the effective delivery costs. Generally, from a purchase price of CHF 500.00, shipping costs are included.
5. Delivery
   Stock items are shipped immediately after receipt of order. If a product is not in stock, an order confirmation will be sent with the expected delivery date. Compensation claims against Culm as a result of delay in delivery are excluded. Delivery is only made to an invoice address in Switzerland, by Culm itself or a partner authorized by the Culm.
6. Transfer of benefit and damage
   Use and risk shall pass to the Customer upon receipt of the delivery.
7. Retention of title / Withdrawal
   The goods delivered remain the property of Culm until complete payment. If the Purchaser is in default with the payment of the purchase price, Culm is entitled to have the retention of title registered at the expense of the customer in the reservation for the reservation of ownership or to take possession of the goods again after the declaration of rescission.
8. Complaints / returns of merchandise
   Complaints are to be made within 10 days from the date of dispatch with Culm in writing, otherwise the delivery is considered as faultless. Delivered goods can only be returned with the express consent of the Culm. It must be in perfect original packaging and in absolutely new condition. In any case, the returns must be indicated with the reason and our order no. in advance.
9. Design / technical data / modifications
   Changes in the design or in the technical area, which improve the function and quality of an article, as well as errors in description, pictures and price are reserved.
10. Guarantee
    Culm passes the warranty conditions of the original manufacturers generally 1 to 1. In the event that the manufacturer does not warrant any further warranty, Culm shall provide 24 months from the date of delivery to the customer that the products delivered by him are free from material and manufacturing defects if used properly. The warranty is limited to the repair of the defect free of charge, with the Culm deciding whether the defective product is repaired or replaced.
    Any further warranty is excluded. In no event shall the customer’s claims for compensation for damages not resulting from the delivered product itself, in particular loss of production, loss of use, loss of orders, lost profits and other indirect damages.
11. gross budget rule
    The settlement of any claims of the customer with demands of the Culm is excluded.
12. Applicable Law and Jurisdiction
    The contracts concluded with Culm are subject to Swiss law.The court of jurisdiction for any disputes with the customer is at Aarau / AG. However, Culm is free to charge the customer at his place of residence or before any other competent court.
